Marshmallow Bust Haunts Woman on Cruise

MIAMI - A teacher's aide who forgot to put away her marshmallows and hot chocolate at Yellowstone National Park last year was taken from her cruise ship cabin in handcuffs and hauled before a judge Friday, accused of failing to pay the year-old fine.

Hope Clarke, 32, crying and in leg shackles, told the judge she was rousted at 6:30 a.m. by federal agents after the ship returned to Miami from Mexico. She insisted that she had been required to pay the $50 fine before she could leave Yellowstone, which has strict rules about food storage to prevent wildlife from eating human food.

Customs agents meet all cruise ships arriving from foreign ports and run random checks of passenger lists, and a warrant claiming Clarke had not paid the fine was found in the federal law enforcement database.

Assistant U.S. Attorney Peter Outerbridge conceded there were some "discrepancies," but suggested to the judge that Clarke appear in court again to clear up the warrant.

U.S. Magistrate Judge John O'Sullivan, who had a copy of a citation indicating the fine had been paid, apologized to Clarke, who spent nearly nine hours in detention, and demanded that the U.S. attorney's office determine what went wrong.

Zach Mann, spokesman for U.S. Immigration and Customs Enforcement, called the arrest "an unfortunate set of circumstances." He added, "We were acting on what we believed was accurate information."

seiously, i think it is rather disturbing that there still exists the lack of communcation between legal authorities in this country. That was one thing that was supposed to change since 9/11.
of course i could be sarcastic and say that "hey, it's Florida, she could be a democrat, and needs to be purged from the voters list" but I won't

Hey, aren't you supposed to be workin' at your new job by now? Go on, get outa here will ya?

In regards to Ashcroft, the lady's warrant went into the federal law enforcement database, even though it appears she already paid for the fine. Then the Assistant U.S. Attorney Peter Outerbridge conceded there were some "discrepancies." From this U.S. Attorney's admittance, I concluded Ashcroft's office had a hand in this error. Was that an incorrect conclusion, and if so, why would the U.S. Attorney admit the possible mistake if his office played no role?

Hey, I don't mind folks bein' tough on the environment, so long as they get their facts straight and their outstanding warrant database updated.

Heh I bet ashcroft doesn't even know what a database is much less manipulate one to generate a discrepancy. Sounds to me like they have terrorist cells in their software.

Anyway I don't start my new job until july 6. So I have a week left in my crappy job where I'm going to surf and post a lot. I have a week of being unemployed where I'm going to surf and post A LOT. And then I start my new job ... where I'm going to surf and post a lot hehe.

Highly unlikely anyone in Washington had anything to do with this. There are thousands of Assistant US Attorneys all over the country, all of whom have the first jurisdiction over the cases in their area. It's just a local screw-up based on federal info.

Since I'm not entirely sure myself, I'll take your word for it. Thanks for the clarification. I should retract the title of the thread then, if I was somehow able to do so.

I just love that they are arresting American Citizens for not paying fines at Yellowstone when they should be (according to what they say they are doing) hunting down terrorists.

Hell, the Customs people did not even look at my little form I filled out when I came back from Australia, they just let me through. Then they made us go back through a TSA checkpoint when we were already in a more secure area.

Good old government efficiency.
