Subpoena dodging

i got 2 subpoena's in the mail from Colorado (im in NYC). Not certified, just regular mail. Im an eye witness in an assualt charge. I dont want to testify though. (i dont want to explain why)
im wondering if there is anyway to dodge this. "i never got it?"???

well i just had a friend jet to Cali mostly because he wanted to avoid 16 hrs of community service and court date...lol, yeah thats pretty stupid. what comes of him, only time will tell...

but being in CO i DO know that my friend got a ticket in Nebraska that he never paid, and got his license revoked. thats pretty mediocre, but anything more serious is likely follow a similar course.

that being said, it seems that you dont have to testify if you dont want to. that may mean showing up, and not saying anything...but certainly, avoiding the situation wont solve it|

if you dodge the subpoena, the situation might get worse. i wouldn't suggest it.

if you want, get an attorney to quash the subpoena.

Wouldn't the CO court system have to pay to get you out there? I say take a trip to Colorado on their bill.

Seems like it, there's no way they could make you pay for it yourself? That shit would be fucked up.

And btw, the weather out here is like spring right now, we got virtually no snow, but the mountains are still covered pretty nicely and snowboarding is still going on and stuff. So if you wanted to take a trip out here like jpisani suggested, you could always do a day of snowboarding for about $100 (for transportation to and from mountain, ski pass, and rentals).


And could you explain why you don't wanna testify, or tell us what happened? Might be amusing.

Normally a subpoena delivered by mail would have a form attached for you to sign and return to acknowledge that you've recieved the subpoena and intend to abide by it.

Typically if they don't get this back pretty quick, they'll send someone to serve you in person. But being out of state, they may not bother.

great comments guys. thanks. and in the past day ive learned that CO. subpoena's have no jurisdiction (sp?) here. It came in the mail and it was not certified. Enclosed with the subpoena was a number to call for free travel and hotel. I just dont want to go though. Its the worst sub-urban area ive ever lived. The ignorance there is overwhelming. There are good people out there...i just never met them. Prob explains why im dodging a subpoena. I do have a couple of good friends out there though. Shawn Mitiska is damn cool, and a nice guy for hooking me up with so many VST's. For those wondering wat im being subpoena'd for. I was an eye witness in a Assault 1 -EXTREME. (asian gang fight, seen one u seen em all) Thanks for the help you all....if u have anything else to add...please speak up. I think i really am gonna go through with dodging it.
