Angry I think I gone 'n' screwed myself

How stupid do I feel right now?

I manage to get a wicked apartment with my buddy at King and Bathurst. We were supposed to be moving in today, but something very sketchy is going on. The current tennant seems to be taking his sweet time moving out, and the landlord isn't pushing him too hard. Sadly, there's nothing we can do about is because buddy paid for all of Feburary, then we were going to take the place over, not pay for the rest of Feb and clean it ourselves.

My buddy NEEDS a place to live by Friday, no question, and we're definately taking this place. It's too funky to pass up. Only thing I can think of is, when I see him tomorrow offer him a cheque for the rest of the month like we originally planned.

We were originally gonna hit System on Friday to celebrate, but that won't be happening now, the way things are going.

The situation's gone out of hand. He's cashed the deposit, but we made him sign a form saying he can't fuck us.

Anyone have any thoughts or ideas on how to sort this out?

Be forcefull, but in a firm, polite way.

Show up, saying you're doing so in advance of the moving truck to collect keys etc.

Onsite troubleshooting is always the best, as you can deal with everything instantly, and pressure effectively.

If you need to, keep your friend's stuff in a moving truck for an extra day if you load it and end up with no place to unload. You can take it off the rent.

I've dealt with moving in this city dozens of times for myself, and can't count the number of friends I've moved. (I'm that dependable guy with a driver's license and muscles)

Is the other tenant moving at all or is he just staying there.

If the decided date was today then you have every right to move your stuff right in and not care about the other tennant. Make sure you check what was written on what you signed.

I hate to break the news: BUT IF the other tenant DOES NOT move out -YOU don't have every right to move in.

What would happen would be up to the move of the landlord - even though he has cashed ur cheque. He would have to go through the proper eviction process to get the current tenant out which could take a long time (up to a month or longer depending on the housing tribunal). Then what would happen is you would have to re-coup the costs from the tenant and landlord in court. NOW hopefully the landlord, if the tenant does not move out, gives you your money back. Sorry to break it too you but I have been in this industry for far too long to tell you I have seen this happen to too many people. YES YOU can get all your costs back - but this all takes time...I hope he moves out for your benefit....Good luck

Thanks guys.

We see no point in taking any legal action against the guy, I mean, Feburary ends pretty soon after all. My friend's been the agressive one in all this, since he's got more access to the landlord then me. .

Keep in mind, Feburary was supposed to be free for us. We don't have much that needs moving. Between the two of us we can do it with a cargo van from Discount, and even fit in a run to Ikea to pick up furniature.

We just wanna get it over and done. As far as the lease goes it doesn't say anything about Feburary, he was gonna let us have it out of good will. Probably why it's taking so long, but there's nothing we can do about it.

Hopefully I'll know something tonight. Hopefully.

If your move in date is March 1 you can't do anything until that time. Legal action isnt even an option. They would laugh at you.
