ebay?

Ok so I'm looking for some comments on what my actions should ethically be considering a current transaction gone bad on ebay.

I am the buyer. The seller marked the product payment recieved JAN 27th. he then sent me a much cheaper product in the box of the product that I actually wanted, and even that took a month to get to me. I sent it back to him.

I have sent this guy numerous emails, and he never responds. I call the guy and he tells me to email him. I have finally in the last two weeks had with this SOB since he keeps Bullshitting me telling me that it will be shipped tomorrow yada yada every time I call. Just now I got off the phone with him and told him that I didn't give a shit where the product was I wanted the money refunded back to my credit card. He told me the same story saying it would be in the mail by friday... oh wait next friday. I then asked him if it was next friday or in 6 months. he said no by next friday. I then responded with I want a tracking number by this monday otherwise I want confirmation of a refund by this tuesday. He said fine.

My question is this 1) I have not left negative feedback yet dispite feeling ripped off and scammed. Since I bought this product others have noted in his feedback being treated the same way. (when i bought it his feedback was much better). Should I leave negative feedback even if he completes the transaction (either by shipping it to me finally or via refund)? Or is that only reserved for a complete scam. 2) Since I have been B'S'ed around so much by this guy I am planning on filing him with his local better business bureau. That is more or less gaurenteed. My next move if he doens't come through by monday is to call his local police and file him for fraud and also notify ebay.
What would you do in this situation?

ps he also has a history of giving negative feed back to anyone who gives it to him regardless of who is at fault... I currently have a pretty expensive item up for sale and am worried that if he bashes me back then I may not be able to sell it as well given my current limited feedback (which is at 100% positive, but I only have 10 transactions)

I assume the CC transaction has gone through, eh? You did it through Paypal?

I know Paypal sucks fucking ass and odds are you're fucked in this situation, but all you can really do is contact Paypal about the issue and then leave some terrible feedback.

HOWEVER, don't leave like "Didn't get product I paid for. Would not deal with again." kind of feedback, leave negative, but say "AAAAA+++++ IN BED WOULD SLEEP WITH AGAIN, I LOVE THAT TONGUE THING" kind of feedback.

Man, that's some damaging shit.

Forget feedback. Don't give any, the risk of getting negative in return is too high.

Start the dispute process with eBay and PayPal immediately. eBay has a very strict dispute resolution time-line - make sure you follow it. If you miss something by one day - you're SOL.

Story: When someone scammed tw1tch (sent a piece of wood a sweater instead of an EFX-500), I called the guy up pretending to be a "Dective RJ Williamson" and scared the guy to shit to the point where he refunded 95% of tw1tch's order.

nope I called him and gave a credit card number. I can cancel the card anytime if it has bogus charges on it. I only use it for this kind of sketchy stuff so I can keep a close eye on those transactions.

I have this guys personal cell and home address as well. He's about a 4.5 hour drive from where I am in Louisiana currently and am not opposed to driving it and breaking some knee caps over this insignificant bottle of cologne. I can't stand business people that act this way.

The fact that they don't accept the official eBay-sanctioned currency exchange system is sketchy as fuck to me.

And yes, Black is good shit.

Easy solution then. Call the credit card company, file a fraud complaint. If it is a good card company they'll eat the deductable and you'll get your money back.

Details of fraud complaint:

1. You bought the item via auction/telephone order.
2. Item arrived not as described.
3. You returned the item (with tracking/proof of delivery I hope).
4. Seller refuses to re-send purchased item (as originally described).

yes I have proof of return delivery, but I really want to burn this guy if he doesn't come through so he can't do it as easily to other people again.

And yeah I love the Black. I had a small bottle of it but when that ran out I decided to get this back arond the xmas holidays when I was at home and I still don't have it. I would have paid full retail price for this if I knew it was going to be this much drama with the guy.

I know exactly how frustrating this situation is....I was in a similar one for another cheap and relatively insignifigant purchase made on Ebay. After spending the longest fucking time reading BS emails from the seller, I went to paypal and filed a complaint about the buyer, with a demand/request to receive a full refund. What went from being a last ditch effort turned into the best solution....within 8 hours of filing that written complaint, I received an email that all funds were given directly back to my account, everything.


and like you, up to that point I hadn't left feedback......that ****** got railed.


really strange peice of info comming out of that situation, several people then emailed me, somehow, to ask if I would partake in a massive fraud of that guy....quickly...these two guys, who met as a result of their own bad experiances with that seller wanted to organize a massive fraud of bad bids on all of his active autions....I was down, but that never panned out....too bad...

anyways, get your money any way possible, then screw him....

shitt! I was just chatting with an ebay rep and she told me that my time is up. you only 60 days to file a dispute. 90 days to leave feedback, so I still have that option... I think I'll wait until 89 days and then rip him a new one there. then file for fraud on ebay and notify his Better Business bureau and police of small claims fraud and give them his address.
