Is he innocent/guilty? Has he already served enough time?

No one really knows if he's innocent or guilty, the problem is the US is holding him under a sort of quasi-POW pretence in times of war, when all they're doing are police actions.
Lock him up after a trial which finds him guilty, let him go otherwise if he's innocent, but its just a bit ironic fighting 'wars' for freedom and democracy of foreigners while keeping same-said foreigners outside the democratic justice system.
The thing that irritates me the most is by the run up to the federal elections he'll be either running around free as a bird or back here in a cell and the liberal government will milk it for all it's political worth.
I'd almost bet money on it.

Fighting for peace is a bit like Fucking for Virginity, i mean it makes no sense. Anyway IMHO Hicks is as guilty as sin (If you look at some of the things he has said in letters home to his family, it'll make you hair curl!) Hey, look at it this way. The Yanks want to do this, he was there, and did at very least some of what he has been accused of (Providing Material support to a terrorist organisation is the charge), so let the Yanks deal with him. I Feel sorry for his Dad tho

to be honest, the poor bastard has also been tarnished by the media. He can sit in those prisons indefinately or until John Howard gets off his arse, grows some balls and demands him back to serve his time in OZ. If he's guilty of course....that's just it, no conviction, sitting in limbo, fucked...

david hicks was fighting with the army of a recognised government, in a recognised country. sure, the taliban were a disgrace and its good that theyre gone, but he deserved to be treated within the geneva guidelines like any other enemy combattant.
now, if he didnt deserve such treatment, and is labelled as a criminal (though a criminal in what regard i cant fathom) then he deserves a timely trial, another underpinning of our westminster system of law that the US has forgotten).
either way, there are absolutely no grounds for holding someone for such a length of time without charge or trial. the howard govt has again dropped the ball on a very serious issues
you cant lock someone up indefinitely because you dont like their politics. thus far, the US govt has brought zero evidence to light that hicks has done anything at all.
