money is irrelevant here if he's fucked him over. The best thing to try is fucking him back over, beginning legally, screenshot the auction if you still can to prove he said new, then take it to them with the proof that the key is used, and see where it go es. If that fails, send tigerclaw, DA & guns around

Ok. Did you pay with paypal? If not, you're probably fucked.
If you did, I would recommend attempting to contact the seller a couple more times (you never know, he/she might be out of town...prolly not though lol), and if you get no response, then file a claim with paypal, as well as ebay.
Once you file a claim with paypal, they put a hold on the funds associated with the transaction, until something has been worked out. If the seller won't communicate, it works in your favour.
You may need to provide ebay/paypal with proof that it doesn't work (like maybe a photo of the item/instruction/serial code, and a number for them to call to verify that the code doesn't work).
If you can give them enough info as proof, they will pwn him/her and give you your money back.

i did use paypal. i already filed the claim with ebay/half. should i file a claim with paypal too? thing is, the item took almost 2 weeks to get shipped to me, so the guy already has his money. so how can paypal put a hold on the funds?
basically i guess im already trying to get my money back through ebay/half so wouldnt doing it through paypal too void that or something?
