afaik its different in each jurisdiction. i can't think of any place were one is illegal and one is legal. where is this?
in both cases a copy is being made, and there is probably no exemption applicable, and is probably illegal, unless you own the work.
moreover, when you are uploading you are probably distributing, whereas in downloading you are not, and the law treats the former more harshly, generally.
