Tracks with sampled material.

Alot of tracks have stuff sampled from movies, series etc.. especially in psy genre.

How does that work,do they license it first, or do they just put it in their tracks and hope for the best?

Usually you put it in the track then if the track gets signed you look to license the sample. Sometimes if you're not gonna sell many units it could be released without clearing the sample, or as a white-label bootleg. If you cant clear the sample but still want a full release sometimes you'll recreate the sample from scratch, hire a vocalist to re-sing vocal samples or whatever...

I thought about it as well.Like in Andy Bluemans "Time to rest" track he uses a phrase from a movie called Closer (I think thats the name)but i guess it depends on how popular the track gets...

Virtually no-one actually clears the use for copyrighted samples. Unless their famous and can't get away unnoticed.

Rob Zombie used a sound clip from a movie in one of his songs, and that song was all over the radio. I heard him say himself that he didn't get permission to use the sound clip. It was from an old, obscure horror movie. He was hoping no one was going to come after him about it. I think the reason he wasn't worried too much, is because the movie was out of print and the company that made it probably doesn't even exist anymore. So maybe that isn't a good example. Nevertheless, I was a bit surprised that he used that clip without permission.

If you are going to sell a track, use movie clips at your own risk. Most likely nothing will happen, but you never know. I personally wouldn't want that on my mind. Don't ever use Star Wars clips, because George lucas is a pitbull when it comes to copyright infringement.
