Former Officer Johannes Mehserle, has been taken into custody.
Held on no bail...
OAKLAND — Johannes Mehserle, the BART police officer who shot and killed an unarmed man New Year's Day, has been arrested, a high-ranking Oakland city official confirmed late Tuesday.
It was not clear what charges Mehserle could face. David Chai, the chief of staff for Mayor Ron Dellums, who confirmed the arrest, said he knew no further details.
Mehserle's killing of Oscar Grant III has led to massive public outcry, particularly since video of the shooting surfaced.

If I were Johannes, I would have stayed a cop, at least until the investigation was over. I'd still have the protection of my peers, kinda. They might have even tried to help cover up whatever was being played by the media.
Hes kinda f*cked. The only protection hes going to receive is what brand of condom he offers to the many people that will be his buttpilot for years to come.

I don't see murder. Murder is killing of a human being by another human being with malice.
4 ways to get 2nd degree murder.
1. Intent to kill
2. Intent to cause grave bodily injury
3. Substantially likelihood of death...also called depraved heart or malignant heart...example shooting into a room full of people.
4. Felony murder rule - death as a result of an inherently dangerous felony.
For 1st degree you need either
1. Premeditation and deliberation.
2. Killing by means of bomb, torture, poison or ambush.
3. During the commission of specific enumerated felonies like Burglary, Arson, Rape, Robbery, Kidnapping or Mayhem.
Looks more like manslaughter
Voluntary manslaughter - done in heat of passion or sudden quarrel. example: You see your wife sleeping with another man and kill the man.
Involuntary manslaughter - Is unintentional death w/ reckless disreguard. (something more than negligence)
Looks like involuntary manslaughter to me since from what I've heard he thought he was reaching for his tazer.
