I have had sympatico and rogers in my years on the net. I currently have Rogers Cable, Rogers Digital Cable. The digital cable customer service people are great and so are the cable subscribers. Then again, I must know how to effectively complain better than you guys. Sympatico had the worst service on the face of this earth and they have been taken to court in class action lawsuits. If you have bell, do you realize that they charge you 8 bucks a month to use their email spam filters, and charge you for it even if you don't ask for it. Sympatico has a great service reliability then they got greedy and wanted to cap the bandwidth, I do understand bandwidth is not cheap but they came after my household because they said we downloaded 30gb in a month....me and my brother downloaded 3gb each (we did not upload a thing that month) and my father concluded it was flawed. We went to Rogers and have had virtually no problems then again I guess they want to service ppl like me, cuz my parents have rogers cellphones also....and they are vip's. My big beef was I hosted my 29kb sig on the webspace and they claimed i went over the 300mb traffic limit. I did not believe this and then spoke to swamper and he concluded that 11,000 looking at my sig would do it. So I've take that down for a while. Rogers and Bell need to learn effective customer service, because no wonder people are fed up and they are losing money. People are so fed up, they take out the internet all together or the television cable all together.

I voted YES. If the contract states no limit, then there should be no limit. If the contract states that excess usage will be punished they should state how much they consider excess! Just saying it, does not give the user any kind of boundries. And as to him being the top 1%. If the average user is only downloading say 5 gigs a month, then ofcourse he is the top 1%. But most people do not download too much. So his usage is going to seem excessive. Tell him not to worry, I download anywhere up to 5 gigs a night as well. I am currently with Bell, they removed their limit. My total was 80 gigs last month, and they have not said anything to me.

Rogers is a very bad company, and i was with bell even during the bandwitdth gap, beucase i hate dealing with rogers.

This should help (God bless google)..

Look at 7g.

Seems like a cover your ass shady clause in the EUA. It could mean whatever their army of lawyers want it to mean.

Unlimited is an advertising buzzword. Just because people don't read the fine print in the TOS doesn't make them innocent! As for them stating what they consider to be excessive, THEY JUST STATED IT! This guy hasn't been charged any money for his excess bandwidth, he was just issued a warning, so now he knows, he's in the top 1% and that's bad... what's the problem with that? If they started charging him without a warning, then I could see reason to be pissed off.

I'm no fan of Rogers, but they're a business, they need to turn a profit like any other business. Frankly, I think 4-5 gigs a night is taking advantage of their unlimited service. It's like going to the supermarket and snatching the entire tray of free samples.

Let's also not forget that they did e-mail all their customers a few months ago to say that they were implementing a system to monitor bandwidth. People knew this was coming.

i agree with your friends, unless it says specifically that he cant download more than 5 gigs a night, then he should be able to do it...excessive doesnt mean a thing.

but dont complain about that!!! it just took me SIXTEEN minutes to check my email, 4 minutes to post this (just to load the post, not the thread), and i cant connect to msn...

to make it worse, my parents have paid the rogers bill untill december 31....so im screwed till then, ill be stuck with my 200bytes/sec downloads for 45$/month...

PS. tell ur friend to check teh internet cotnract to see if there is any clause which says tehy can do that to him. if not, he could sue them for all taht matters or demand compensation for their actions

I agree....

Um, I'd have to believe that he's not getting a "slow ass" connection if he's able to download 5 gigs a night. That averages out to 60 kB/sec if his downloading is constant all day. If you, say, limit the internet time to 10 hours, it's more like 150 kB/s. So this really isn't the appropriate time or place to be complaining about their speed of service.

To be completely honest, I don't think a lot of you guys are thinking rationally - you just want to bash the big, faceless corporation. Like I said, I hate Rogers' service with a flaming passion, but in this case, they just didn't do anything wrong. It's all in that clause in the TOS.

They don't have to tell him specifically what he can and can't use. That's not what the contract says. The contract says that they reserve the right to amend the service if someone is using what THEY DEEM TO BE excessive bandwidth. You signed the contract, don't whine! You're going to get in a lot of trouble if you're ever working in big business and sign a stupid contract and complain about it's "unfairness" later on! Frankly, I don't think they've been unfair at all. They gave him a warning - they didn't charge him any extra or cut off his service - and they've bothered only 1% of their customers about this.
