Simple pocession of weed is either only a minor offense or a misdemeanor in US states (not sure how strict Virginia is)...whether they'll get him for a driving under the influence affects it too but with only pocession the most he would ever do would be 3 months in jail, but his dad's the former vice president, so not much will actually be happening to him.
