haha that actually reminded me of when I lived down by detroit. My friend had the same exact name as a wanted felon, same kinda height and weight....so they cuffed him adn threw him in the car. but I guess they forgot to look that the race of the other guy....the other dude was african american, my buddy was not....



we all laughed afterwards, kinda amusing to me.



but yea, nights in jail over mistaken shit is not funny, ratehr real shitty.

Yeah, cops really suck. My only brush with the law was when I got pulled over one night for not using my blinker. The cop was just waiting in the McDonald's parking lot, once he saw me turn into the far lane after I made sure nobody was there, he ripped out of the parking lot (more dangerous than anything I'd done) just to pursue me. Thing is, I actually *did* use my blinker - only about 2 or 3 blinks mind you - but he still pulled me over. Asshole.

I've still got his business card - it says the incident number on the back and "failed to signal." I keep it to remember that magical, magical night

The reason I say cops suck, though, is because my father was put in jail for calling someone on the phone. It was the day of their divorce, and once he called my now-ex-stepmother, he left her a very benine message wondering why he got served divorce papers at lunch and how he didn't quite know what was going on. They put him in jail for 3 days and he got 2 years of probation because it was 'domestic violence'. Leaving an innocent message asking for her to talk to him about this sudden divorce.

Fuck the legal system.

IMO you should have just gone back inside then stayed there. What the hell would they have done? He can't enter and take you out without an arrest warrant. Just lean out the window and proclaim that you haven't been hitting any golf balls today and then just stay inside. Fuck those assholes...

Cops can enter your household (especially an apartment, which you do not own) if they have probable cause. It's not like your house is 'base' or something like that

They will do what they need to do to take out the enemy... unfortunately, that enemy seems to be the citizens of the United States of America so we're pretty much fucked...

Not quite right. In order to enter your household they would need one of the following:

1. A warrant.
OR
2. Your voluntary consent.
OR
3. BOTH probable cause AND sufficiently exigent circumstances.

The standard of "sufficiently exigent circumstances" is met when the police have probable cause to believe not only that a crime has been committed, but also that someone's life is in danger, a suspect will escape, or that you might destroy the evidence of the crime.

In this case, the standard was certainly NOT met:

1. Your identity has already been established, and you are not in the process of fleeing arrest, so you are not a risk to escape.
2. No one's life is endangered by a broken window.
3. There is no reason to suggest that you will destroy any evidence of the crime.

These are the standards for investigations pertaining to felony offenses, by the way. In your case it would most likely be even more difficult for the officer to obtain legal permission to enter your home.

In this case you gain nothing by cooperating. In a similar situation, I would advise you to tell the officer that you have nothing to say on the matter and demand he leave your property immediately until he has a valid warrant. If he doesn't leave immediately, take down his name and badge number and then contact an attorney. You may have a valid civil rights complaint.
