I'd say there are 2 reasons. Unlike Milosevic, Saddam was not worldwide recognized as a threat to other countries, and the unilateral US action against him was not supported by the UN. The second reason is that Milosevic fell during the reign of Clinton administration who was not as opposed to the ICJ project as the current Bush administration is. Besides, the court in Hague was initially established as a court whose jurisdiction was only applicable to former Yugoslavia, with the later inclusion of Rwanda. Other countries must willingly accept the court jurisdiction, something that US government obviously didn't want for Iraq to do.
