ANOTHER cop comes, starts askin me questions... literally 40 minutes go by, finally they say, "since you've been so cooperative, you can go with a warning", im like... well this sucked but whatever, better than a ticket... but 3 cops have to come for this??? they friggin tore that car apart searching it... seriously looked inside AND OUT... one cop actually got under the car and started searching around, they took out the spare tire and were bouncing it around for a good 3 minutes... popped the hood, i swear they looked in every possible spot you could imagine... pissed me off but whatever, i guess they got nothin better to do in south dakota... i hate cops |
Sorry to hear this...but if they want you,
they'll look so bad, they'll look in their own asshole, and accuse
you of putting it inside of it.
True story!!!

Let me tell ya about my story:
St Rd 40 Fla, doing 52 in a 45 zone (1am) , get pulled over for speeding, let off with a warning and as I`am reaching for my lic. he ask "may I search your car?"
I reply "No sir you may Not search my car"
He starts in with "why not unless you have something to hide" "I can get a dog here to do a walk around"
(me) "Fine get a dog but I`am not going to allow you to search my car" "May I have my lic. back and be on my way sir?"
Now another cop pulls up.
(cop2) " Why don`t you just let us search your car and you can be on your, what is it that your trying to hide"
(me) "No sir you may not search my car"
now cop 1 walks around the car flashing his light inside and see`s my wife , he starts to ask her to open the door so he can look inside - she ask "why" .
He now gets upset and again they both ask me to allow them to search the car, both giving me a mean stare.
(me) "No sir you may not search my car as I have done nothing wrong and its within my rights to say no"
This goes on for 30mins+ and I have given them no reason to search the car- just a simple reply stating "No sir you may not search my car"
So cop 1 hands me a piece of paper stating that I refused to allow them to search my car to sign. I do this as they say it would have far easier to just let them look around and I would have been on my way long ago.
No I didn`t have any drugs,pipes,ect but its YOUR RIGHT to say No. If they had a valid reason they would have just done a search not needing your permission, so NEVER just let them search your car.
My wife has a coworker who`s son was stopped and they asked to search the car, well being a young kid who thought `I have nothing to hide allowed the search. Well they took the car apart on the side of the Highway doing $2000 damage to the car and found nothing. The father has been fighting the state over this for almost 3yrs now with no luck.
My lawyer was proud when I told him how I handled the traffic stop. Its well within your rights to say "No sir you may not search my car" be nice but firm and know that if they had a real reason they wouldn`t be asking. They are hoping you just say yes and at that point you just gave away your last right.
Its a lose/lose situation if you just allow them to search your car.

Got balls there, Dale. Most people would wilt rather than keeping say no to a cop. I found this website a long time ago which will send anyone a pocket Constitution for $5. Suggest have one in their car if they need it. It details the Bill of Rights and some other laws. There are too many cops who are arrogant. so if someone said "No sir, I'd rather you not search" and keep repeating that (but not give the reason why), the cop will eventually give up. Unless he can see something visibly or smell something, he can't just decide "Well me and the boys are calling out the dogs and we're gonna rip your fucking h00pty apart. And strip search your ass, hang ya on that tree over there.... u got a few hours to spare, I hope?"
There have been recent court cases (Supreme Court issued a ruling about 2-3 yrs ago) about what a police/highway patrol officer can/CANNOT do. One of those rights IS to search your car but only with "reasonable suspicion" which they have to back up with evidence in court. Although cops always bend the rules, and lie like all Hell without any conscience, their ass is on the line. Enough bad stops & they'll be in trouble with the department.
Bottom line: Know your Constitional rights, be calm, and be firm.
