If that were true (re oxygen), it doesn't matter about patenting, or money making. It would be used in hospitals, in fact if it did actually work and it wasn't patented people would be using it for the very fact it wasn't patented.
All it would take is a hospital or uni researcher to follow up on it and they would be world famous, nobel prize shit right there.
And you can patent the use of something.
For example, a process called PCR which is used to amplify DNA (you've seen it done on CSI I'm sure). That process is patented using a naturally occuring protein (Taq polymerase). The process of treating cancer with oxygen can be patented in the same way.
In addition, most malignant tumours have blood vessels that suply them with, of all things, oxygen which is required for tumour growth.
The reason (if true) it isn't widespread would be because of efficacy or practicality issues, not patents.
I'm too busy atm to look into this but if you want to send links I'll read them at some stage.
