Monkey is the at fault party. What I'm saying is that if I were the lady she hit I'd want to claim against my own policy (under Direct compensation) rather then settling privately. I can trust my insurance company, I cannot say the same for the person who rear-ended me.

I've been driving for 10 years and I probably drive twice as much as most people do in one year, but sometimes you just get lazy... it was a regular corner that I turn... I think most accidents happen within 10km of your home right?

That's what I heard. But, it's true ... you tend to get lazy near the home stretch. I wasn't assuming you were a new driver, shit happens to everyone and I was just giving you an example which I had that was like yours.

That is a good idea, but from personal experience I can tell you that contracts like this often are not all that they would appear to be.
It is still possible to get screwed. The ontario court system does not give much help in honouring these type of agreements.
