He's broken no Australian laws, and the new ones cannot be applied retrospectively –_i believe if he was brought home he would pretty much have to be released immediately, although i am sure they'd have a crack at slapping one of those control orders on him.

It doesn't happpen very often, but pkc is on the money imo

He was Al Qaeda)and you commit a crime and get caught, then you have no right to expect your Govt will bring you home and let you off the hook. He got caught, he's gotta deal with it.

i dont think that people should be held like that without knowing what is going to happen to them. like pkc said, he was fighting for the government of a country that got invaded. the way the US has worded some of their anti-terrorism laws is a bit fucked and it's pretty stupid the way they get away with stuff like this. especially when a lot of these problems are their fault after being scared of communism for 40 years or whatever. i think it's even worse that our government has done basically nothing to help one of it's citizens in this situation. if they have done something wrong and are a criminal and there is evidence then they should be charged and trialled and put in jail. i don't see why it should take so long.

isn't that base in some kind of "limbo" as to where it is? it is an american base but isn't considered american ground like an embassy so if you don't get any rights or something, and even though cuba owns the land and leases it to the US it isn't counted as cuban so they can't do anything??

where does the line get drawn to separate a prisoner of war from an "enemy combatant"?

Good Point Philby. I Still think he is guilty, and i still think a lot of people are jumping on the "Bring him back" bandwagon for all the wrong reasons, but you present a very valid and logical argument.

For the Record i voted "Give him a fair Trial" in the Poll, even though i think it is unlikely he will get one (And that is Bullshit IMHO)

I think you'll find the majority of people who want him brought back don't take that position because they believe he's innocent but rather because of a belief in the main pillar of justice in democratic society - the right to a fair & transparent trial.

I think he is guilty and he can rot in prison, but he still deserves a fair trial which will lead to the verdict for him to rot in prison.

Yea, that about sums it up. Stop treating him like an animal and trial him here, then lock him up forever and lets move on.

Where are these letters he wrote to his family?
The reason David has not yet been brought to trial is because the US Govt has not been able to prove anything apart from the fact he was in the country. He was charged years ago and the charges were thrown out, so they made up some others. it is my understanding that these too were recently dropped and replaced with something else, again because of a lack of evidence. I think he should be supported by our government in the same way the Brits were. Howard's government is a joke. he goes on about human rights in China, and fails to defend an Aussie citizen in what equates to a concentration camp.
