i hear your argument, and it is a good one.

however, if someone sends a "spy" into another place, looking for intel, they will be executed immediately after being interrogated (if they are lucky).

where is the difference?

I speak from the example of 'hackers' that go out of their way to report an exploit/security hole and then get charged for something. I agree, it is not easy to prove that no harm was done - I'm just saying - some script kiddie who sends you a bad .exe that gives him access to your HD shouldn't be looped together with identity theft/corporate espionage/etc.

It's not as Black & White as you make it out to be - however, if done right, even in your example it may just be seen as trespassing if there was no way to prove the door was locked or that the alarm was on.

What I'm trying to say is that 'Hacking' has so many levels of severity that throwing it all under one term/umbrella is misleading.

I'd say it's a pretty common way of getting hotmail/Gmail/Myspace passwords. All you really need is an MD5 hash cracker (i forget the name of the other encryption) which can be broken in browser through javascript.

Anyone hear about Russia using hackers to attack the government of Estonia? I was trying to look for the thread on the PDD, but I couldn't find it. I was just finding it interesting of other governments using cyber terrorism to attack another nation. And I wonder if this tactic may soon be a recurring trend.

it kind of is black and white in that breaking the plane of the front door (the door doesn't have to be moved) is considered breaking and entering. it is entering a private place.


but sounds like we come from similar backgrounds, and I fully agree with ya, there are different levels of 'hacks' and while hard to prove, there has to be different punishments for different types.
