Not only that, but he could probably sue the employer if they posted it on some online video site. Employee surveillance clauses in contracts don't exactly permit public dissemination.

I don't think it's fake at all. I think he's just too embarrassed to take any legal action with it. Dude, there's waaay too many videos online that beg for lawsuits, you really think every one of them have a lawsuit against them? If that was the case there wouldn't be any videos left online.
And i really don't think the "confrontation" with managers should have any bearing on whether this video is real or not. Who knows, maybe his coworkers just wanted a good laugh out of it...
