Purchasing the mp3 gives you the license to play it out in public. Burn it to a cd and play in your car, play at the club...no reason that isn't legal.

Unless Italy has some very very very strange laws I think you are mistaken. As long as you are not selling the mp3s/CDs for financial gain then you can do whatever you want with them. Some will in the finest of print (usually distributors) that it can't be played for public performance. Pretty much every vinyl ever pressed had that on it too. Don't ask me why they wasted the ink or the time. Have never heard of a single lawsuit arising from this.

Also, I'm pretty sure that you are mistaken when you say "illegal" - Illegal is a criminal term - Again I don't know anything about Italian law, but anything that arises from you playing mp3s on a burnt CD in a club is going to be a civil suit, not a criminal suit.

But we're getting way too deep here. You have absolutely nothing to worry about. There is no money left in music anymore (and even if there was you would still be fine) for anybody to care. You could probably publish a CD in the USA if you took a bunch of tracks from smaller labels who are not in the USA. They wouldn't be able to do jack shit. They COULD spend 5 figures to come try and sue you, but we all know that won't happen. At worst they'll bad mouth you to belief and try to get the distributorship license revoked of the label who put it out.

I've always wanted to test this theory but I don't have a label I can risk having ruined, yet

Finally, you CAN send out CDs for donations. I knew some artists back in the day when mp3s first hit the shelves that were "accepting donations" for their latest mix efforts. Their websites wouldn't say it (obviously) but you wouldn't get their newest mix CD unless you donated at least $6

man i'm not mistaken, i'm sure of that is not law, is an association called SIAE ! if i buy a digital song i'cant reproduce it in a club without paying somethig to the SIAE;

yea i know it is crazy but this is Italy the ''Banana country''

check it in google; to produce a song with an italian Label i have to pay 200 eur per year to this association

Well that is crazy. Give me your email and I will give you tracks (in mp3 format) from my label that you can use for public performance. There is no way Italy can force you to pay a fee for using the mp3 codec process, and if they do I'll send it in WAV format, or AIFF format, or MP4 format, or whatever. That is ridiculous.

yes that's ridiculous ! for example: if i want to play your tracks in a Club, i have to pay 5 eur per song to the SIAE (this is only an exmple i'dont know how much)
This money at the end of the year go to your label, but we don't know how much is it..
it is somethig like a ''legal mafia'' ! there is no way !

even if i buy a CD, DVD, USB PEN or an HD i have to pay about +20% more because SIAE want it !
