Ragardless if it's physically damaging, it's mentally damaging enough for you to argue your way out of your lease. I'm sure if you can measure the dB level of that low wave, it'd be strong enough to argue that this shit can lead to long-term hearing loss. But again, a low sine wave is the most noxious sound, and you shouldn't have to be stuck at this new apt because of that.
