A few points after reading this thread:

1) livesets are still copyrighted. The set itself is not copyrighted (unless its from a mix cd), but the individual songs are. Copyright is a complicated subject - too much to explain here and sufficient info on the web.

2) track listings of a live set - i think the BBC is stepping over the line. How can a track listing be copyrighted? The only reason I can see is that they got preasured by the "Industry" and took action for that reason.

3) although internet radio curretly is free - i don't know how long this business model will last with the new rules on webstreaming and the $$$ companies have to pay for it. Whether they give it you for free or not is their decision - but if they do they won't last.

4) Some solutions to the above (and also if TA would be shut down) is to move to the P2P architecture. Someone would have to write a client which accesses a distributed database of tracklistings. [ hey - thats an idea - if i could programme i would do it myself]. Then someone would also need to think of a way to have a distributed forum like this, but based on P2P.

anyway....

they can close us down, they can sue us, but they will never stop the distribution of free music as long as you pay $13 for a cd of which $12 goes to the Industry.

i thin kthe main point with those sites is they completly revovled aroudn the distribution of whatever they were sharing ie. live sets. swamper has been very careful with stuff liek that on this site, which is mainy used for discussion of music.

Sunday 11th May 2003:
Saw him in the evening and he was acting really strangely. I went shopping in the afternoon with the girls and I did turn up a bit late so I thought it might be that. The bar was really crowded and loud so I suggested we go somewhere quieter to talk. He was still very subdued and distracted so I suggested we go somewhere nice to eat.

I asked him again if there was something the matter but he just half shook his head and turned the television on. After about 10 minutes of silence, I said I was going upstairs to bed. I put my arms around him and told him that I loved him deeply. He just gave a sigh, and a sad sort of smile. He didn't follow me up, but later he did, and I was surprised when we made love. He still seemed distant and a bit cold, and I started to think that he was going to leave me, and that he had found someone else. I cried myself to sleep.

Take television for instance, a TV station has permission to broadcast a movie. This doesn't give you the legal right to tape this movie and then share it with 20,000 people. The same principle is true with music, radio stations pay royalties for the privilege. Just because the tunes are mixed and not played in full makes no difference as far as copyright is concerned.

People assume that because the recording industry has in the past turned a blind eye to liveset sharing that it's a legal right. It's not, it's just tolerated.

tracklistings.org is still....last I checked. I thought it was ineptude why it has not been updated in months. There are other essential mix tracklist pages.

copyright question

What about private mixes released as promo? Like the mixes from Kuffdam, Substance, Gemini... which are available on their websites...

Are they illegal, too? (no difference to livesets in my opinion)

i don't know about these mixes - but if they contain records to which the people offering the download do not own the copyright then officially it is not allowed.

There is definitely no legal justification for closing down a site with only tracklistings, not actually livesets. Probably the people running the site were threatened with a lawsuit, and backed off, although they could have won if it actually went to court (but it would have cost them $$ to pay for their defense).

Alternately it could have been the hosting company that was threatened, and it was easier for them to just take the page offline than to bother dealing with the legal issues behind it.
