Yes except the patriot act 2 is nowhere near being passed and it probably won't be passed.

What about the first Patriot Act? It was passed last year and it is a threat to many of our civil liberties. Among many other "threats," the Patriot Act:
-Allows for indefinite detention of non-citizens who are not terrorists who have only minor visa violations.
-Minimizes judicial supervision of federal telephone and Internet surveillance by law enforcement authorities.
-Expands the ability of the government to conduct secret searches.
-Gives the Attorney General and the Secretary of State the power to designate domestic groups as terrorist organizations using vague criteria for defining a terrorist organization
-Grants the FBI broad access to sensitive personal and business records about individuals without having to show evidence of a crime.
-Leads to large-scale investigations of American citizens by the CIA for "intelligence" purposes.
-Demands that American citizens drape themselves with flags or other empty symbols and slogans.
Okay, the last one I made up, but the rest are entirely accurate. Anyway, check out Nancy Chang's short but concise book on the subject, "Silencing Political Dissent."

Infringements on civil liberties as defined by the constitution yes ... a rise of facism no.
Actually all of these policies are indicative of US policies adopted at war time. Check out WW2 government acts if you disbelief me.
