You would only settle out of court if you're guilty. Paying the money is better than doing the time. If he was innocent he would have went to court and won. Once you see the evidence, you say O SHIT! we need to settle this out of court so i dont go to jail.

That makes no sense. The jury in a court USES the balance of probabilities [burden of proof]. The one used here is the "beyond a reasonable doubt" burden of proof. And they found him not guilty of all charges.

So the very thing that you say you use, they used. And they are in a better position to find culpability than you are.
