But how do we KNOW she was 'drunk'? She coulda been on crack, or driving without a licence (hence, the poor driving skills).

In '92/'93 a friend was in a car accident driving in a car just ahead or behind me. The guy who was at fault stopped, and it seemed obvious to me that he was messed up. I told the cops that I suspected he was on E (he just seemed to lovey-dovey to be drunk), but I'm sure they didn't bother testing him, since the end result wouldn't have resulted in a fine they can pocket for the gov't.
