No, in this case, the primary beat signature defines whether or not it is a breaks tune.
Eg. Deepsky - Let me Live is predominantly a breakbeat drum signature, with a section of 4x4. Thus it is breaks.
The majority of the track needs to have broken beats for it to be breaks.
When I say trancey breaks, I mean breaks percs/drums, with trancey type synths/melodies.

ill give you an example of a tune that has breaks in it but no one would ever call it a trancey breaks tune. bt - sunblind. pure trance regardless of the fact that it has a tiny breaks section in it.
