Imo, the ruling was fair. According to Todt, McLaren has confirmed that it had to install a firewall to prevent information from Stepney from reaching the team in the form of documents. Furthermore, Coughlan has been asked to tell the very same Stepney to stop sending him information, so it seems Mclaren didn't approof of this inside information of Ferrari and tried everything to stop it. What is Todt seriously moaning about? If Mclaren were to blame for this then Ferrari has got the same amount of blame for it since they obviously can't control their own employees too from selling information to it's competitors.
Funny thing is, if Mclaren wanted to use the documents, nobody would have found out about it since the documents would have been kept under strict secret in the Mclaren base so Coulghan couldn't have walked out with the documents to a local printshop and made copies there where the Ferrari documents were discovered.
