Ok, really, DO worry about it. I had to make an entire paper on this, about 100 pages. About legal aspects of sampling, and oh my God ! Really, either make your own if you want to sell it, or modify it so hard that we don't know where you took it from, otherwise it's label vs label if the other label is jealous. I wasn't speaking in the context of this record being signed to a label when I said don't worry about it, it was more in the creative sense.
I'm not stupid or naive enough (Well perhaps stupid enough ) to not know about copyright law but as long as he isn't selling it it doesn't matter.
Drum loops are very difficult to prove ownership on though as very often producers disguise them with more layers and effects.

It's actually not that difficult to obtain permission either if you did decide you wanted to release something with a sample in it although it may be accompanied by a financial agreement.

It also depends on the ruling if they are withdrawn from the shops until an agreement/settlement has been reached if the law has been violated. The CD/Records would only be destroyed if the offender didn't agree to give a percentage (Royalties) of all sales in the future.

People use samples all the time and obtain the rights to do so. Some people even end up with annoying colaborations as a result of it.

You are correct in what you say Belgian Guru and I probably should have made myself clearer, but you also make it sound so impossible to ever use a sample and that's not the case. Perhaps I missread your post though.

Oh no I didn't make it sound as if it was difficult to obtain sample clearance I hope, just that it's very very not good to use samples without clearance in a song you're planning on selling that's all But I think everybody understands now, with both our posts combined
