as for the Italian DJ; a fine shouldnt be higher than the damadge he may have caused. there is no way 2000mp3's is worth a couple of million! thats just crazy. Fine him per song or something, not some huge outrageous number

I agree with Jayx on this one....i really don't think its fair for a "Big Time DJ" to be play'n pirated mp3's. Dude, ur making the money...support ur fellow dj's and buy the damn vinyls....i don't get it. I understand a local dj throw'n on an mp3 here and there..but when u got these huge djs thrown essential mixes/lives recorded sets and what not....i thinks its totally wrong. Sure the fine is hefty but....what can u do.

Its not fair for ANY DJ to be making money off off pirated MP3s. If you are getting paid, BUY THE MUSIC.

How about playing white labels with uncleared samples? Some artist is still getting "ripped off" if you do it.

What if you'd never buy a 50 Cent album, but there's one bit you like in one of the songs that you want to sample? Would you be more forgiving to someone who got the sample without paying, if the person did a good job creatively turning it into something new and exciting? For me, I think a big-time producer would have no excuse, but if you're just a kid who wants to hone his pruduction skills, then I would let it go. (Then sue him when the track gets big.)

however white labels are usually small time and at least the person who did it put a lot of his own work into it. Yes its not the most ethical thing to do but pales in comparison to having a book of pirated MP3s and getting paid weekly to play them.

As for the original material. Anybody who can produce would NEVER use a downloaded sample to work from. They would get the cleanest sample possible directly from the source. If some kid fucking around does this from downloading a song he's probably not going to make it that big anyways.

A "sample" is just a particular sound that's repeated and/or modulated in a track. I think you're using the word incorrectly. The term itself makes no statement about what it contains - it could be an entire a capella or it could be just a snare drum, and you can download many samples that are royalty-free. Almost every producer on the planet uses at least SOME downloaded samples of the latter variety, except the ones that can afford to buy thousands of dollars worth of their own sampling equipment and thousands of dollars worth of sample CDs.

I think what you're trying to say is that good producers don't rip samples from other people's productions? But they could just as easily rip from a CD or from a live show.

To use portions of other people's music you must get that owner's permission first. Usually those artists or label's want financial compensation for that portion or sample. There are entertainment lawyers who specialize in making deals for artists to sample other's work.

If you can reproduce that sound yourself instead of copying it directly then no royalties are due. But thats a hard feat to accomplish especially when vocals are involved.

Yes there are plenty of free samples you are right. Its always free to sample your own flatulence for example
