I have hardly ever heard a live kick drum being used in trance music. They are all synthesized usually. Its very easy to get punchy sounding kick drums. Just buy a couple of decent drum machines and layer the sounds with noise, hi hats or whatever. Re-sample and compress them, simple.

Yes in principle.

But to get a bass drum to fit a bass line for example going from scratch aka a pitch shifting sine would take ages. Why not just grab a bass drum that sound how you want it anyway in under a minute?

Because some people like to be "purists" and want to make everything from scratch. Because they can, or because they want to see if they can. Some people go so far as to not use any audio files in their production at all. [cept vocals maby] And besides if someone is really good at making them, then chances are they can make the kick exactly how they want it, which isn't the case with samples.

The public beleif is that end users have the allowance to use software legally if they pay for a copy of it. Most places including ontario and quebec have consumer protection laws which do not allow for the consumer to be liable for practices which are not sufficient to insure the safety and knowledge of the consumer. Since EULA's are usually deemed indeterminant and infinite, they would not be legally enforcable because they fail the requirements of lawful contract in Canada.


All very true and good post - an EULA has never been tested in court, and therefore there is no legal precident to enforce it. Microsoft have been big pioneers of the EULA but they are shit scared to have one go through court in case it's deemed illegal, and therefore everyone can use their stuff however they want. It's basically a scare tactic, to make you think you're "agreeing" to something legal, which you're not.

However, in this case Vengeance has done it because they know they could get in trouble for sampling other people's stuff. By putting that notice on the CD's, they are trying to protect themselves so the original creator owner comes after you when you have your big hit, rather than them. It wouldn't stand up in court though, so I'm not sure why they bothered?

Eh, Vengeance samples contain plenty of ripped samples. I know I've heard a loop ripped straight from Above & Beyond - Air For Life and also the kick from Far From In Love, just to name a few.

I wouldn't use anything other than one-shot perc samples from Vengeance. Thieving bastards.
