The sexual dynamics we're all aware of simply ought not factor into these kinds of cases. Of course we can imagine some horny teen boy would be totally into it, so it's difficult for some people to recognize what moral scruples are possibly at issue. But the victim is not on trial here. No, it's not 'jump out of the bushes and assault someone' rape, but the majority of rapes occur between two people who know one another, and often after a deliberate isolation or assertion of authority by the assailant. There's simply no reason to assume this case is any different at this point. |

I don't think it's possible to entirely disassociate this type of conduct from an implicit abuse of power, as there's an inherent power dynamic that characterizes the student-teacher relationship that was being used to an illicit end. I also find it irrelevant as to whether or not this was a consensual arrangement, as the teacher is bound both by law and the trust invested in her to approach this minor as someone who, at present, lacks the capacity to properly make such a determination in the first place. That she failed to uphold this with someone who was entrusted into her care qualifies a special circumstance, as far as I'm concerned.
