That depends if you consider fucking dead people an immoral act. If you do, then it's a question of whether you were aware that person died during sex or not. If you were aware, then it is an immoral act. But if you weren't then it's pretty tough to say.
On the other hand, if you don't consider such an act immoral, I don't see anything wrong with that. That is, of course, if you were not responsible for that person's death, or if stopping the intercourse could save the person's life.
The real question without which there is no answer to your question is whether you consider fucking dead people immoral. On one hand you could argue that it stands against the current social norms and that legalization of necrophilic relationships could bring chaos into the society. On the other hand, however, it is not harmful to anyone, infact it even boosts morale to a certain amount of sick and perverted citizens. It's really a tough debate, and one that could open a sort of Pandora's box. Is a marriage between a live and dead person acceptable? Should they be allowed to adopt children? Should marriage with other inanimate objects be allowed?
