Sex is a different matter though. Even mere consent to sex (let alone being taped while having sex) is visciated by intoxication. I haven't read the Borat Judgement and don't even know what the causes of action were so I can't comment on that, save to say that just because one of the plaintiffs' claims was that they were drunk when signing a waiver and the judgement was against the, doesn't mean that the general principle has been overturned (or indeed that the judge even found it necessary to consider that particular claim in his deliberation).
