The only obligation the OLG should have is to keep out minors. Otherwise, adults are adults and if they cant handle themselves they shouldnt go near a casino.

The OLG should never have provided this list....as I said earlier the only thing they should provide is a help line...which they already have. As soon as they provide a list for people to put themselves on they take on a portion of the responsibility to make sure that person doesn't enter the casinos. Its possible that all this baby sitting may come back and bite them in the ass finally. That is the only reason why I would like to see the idiots actually win this lawsuit.

However if they win the lawsuit then there will be a whole new level of babysitting unlike weve seen before. I can imagine little old ladies being ID'd upon entry in order for the OLG to protect their ass. Just like little old ladies are now forced to produce ID to buy cigarettes in ontario since may 31!

2) If these people win this lawsuit, then they have caused the province to lose money due to fraudulently entering the premises and then suing them for it. They lied to get in just by being there. It is their responsibility to stay out, not the province's. They jnew full well that they weren't supposed to be there so by entering they are doing so maliciously. Furthermore, any winnings obtained while being on the property were fraudulently obtained and cost the province and casino money.

So you see, it IS indeed fraud. If certain individuals want to try and pull a scam like this lawsuit then they should have the book thrown at them. Enough is enough

You really don't understand the law do you. In the first instance the minor isn't depriving the bar owner of anything... the LLBO is enforcing the law (which the bar violated by not taking proper mesures to protect themselves against). In the second case, OLG would be ordered to pay damages due to their negligence. In both instances the loses are due to the enforcement of law (statute in the first, tort in the second) not as a direct result of the false pretence.
