That record will contain a detailed summary of all evidence against Mr. Magnotta, and it will then be fully turned over to the Department of Justice’s International Assistance Group, Mr. Botting said.
Next, he said the department will submit the record to authorities in Germany, where Mr. Magnotta will face a two-, three-, or four-day extradition hearing. That hearing is likely to take place roughly six months from now, he said, due simply to normal court-scheduling demands.
Mr. Botting said a German judge will also hear from the defence — likely a capable and high-profile legal aid lawyer appointed to represent Mr. Magnotta — and will then take two weeks or so to decide whether the evidence against Mr. Magnotta is substantial enough to warrant extradition. The German government has the ultimate authority to decide whether to accept the judge’s recommendation, and Mr. Magnotta has the right to both appeal the judge’s decision and then later, should he so choose, the government’s decision. |
