The sanctuary is Australian law, not international. However we basically have no right to those waters, not recognised waters = not recognised sanctuary.

The Navy going down there would be tantamount to piracy. THAT would be an diplomatic incident, not telling the Japanese to leave from territorial waters (which these are not)
