I agree. It would be kind of a nuisance at times, but I'd rather that than people trying to guess what their blood alcohol level is based on how much they drank and ate. There's so many factors that affect blood alcohol level and I don't know how many times I've heard people say "ya, I really shouldn't have driven that night" even though they weren't completely shit faced.

This may sound totally ridiculous, but what about the cost of the fine relating to what they blow? The lower you blow, the lower the fine?

Drinking and driving is something that I feel pretty strong about. Personally, if I know I'm going to have a drink - even just one or two, I just don't both taking the risk. If I got in an accident and hurt someone after only having 2 drinks, I would always wonder if those drinks had an affect even though I felt totally fine.

Unfortunately, most people don't think that way (at least until something like that happens to themselves, or someone close to them)

I love the "just donn't drink if you're going to be driving responses." You people do realize that if the threshold is 0 then you're going to have to wait several hours to get behind the wheel after using mouthwash, if you got Tuesday night you're going to have to cab it to work on Wednesday, and don't even think about driving home from the dentist.

this is not what i agreed with
if the limit is 0.08 then police should not be able to suspend your license at 0.05 especially without a fair dispute and you can't argue that in any way. Reminds me a lot of the "street racing law" where you could have your car taken away without even racing.

Well Im agreeing with you! I'm saying its at that point where you cant drive if you have a drink lol, i just squeezed in my other 15 cents in my verbal diarrhea.

The police are already assholes as it is. What angers me even more is cops can pull you over without probable cause apparently? That's what someone told me, not sure how true that is.

From what i remember before if you were to blow and were in the warn zone but you did not seem or look intoxicated an officer could let you go, it was up to their discretion but if you were intoxicated they could take your license away for 12 hours and give it back to you next day at the police station, you did not have to pay 150 dollar fee like you do now because now they officially suspend it.

So after a month of outright denial, the police have admitted to using rubber bullets at G20. Only because there was overwhelming evidence that they could not deny. So the police lied to us about this, amongst many other things at G20. What else are they lying to us about? And why are so many people still willing to give them, and the state, so many unmitigated powers such as this new law??

*Sigh* Very frustrating, as now I lose several people (not 22yrs old) in my circle of friends who are always willing to DD, provided they can nurse a beer while we're out.

The most irritating thing is that it's not "You have to be 21", you have to be over 21 years, 364 days, 11 hours and 59 seconds to have any BAC level.

Most worrisome, as Chem said, is that you'd have to cab it home from the dentist after using mouthwash? Chicken Alfredo with white wine sauce could push you over 0%. (Whether it's detectable or not is its own argument.)

I would think that the .05-.08 license suspensions, along with the existing <.08 DUI laws would teach the same lessons? If a "young adult" (restate the irritation of 21 days, 364 days...etc years old) has 2 drinks, hits that .05 threshold and has to pay for their car being towed + a cab ride home + back to the station to pick up their suspended license...Wouldn't that teach them a lesson about
a) their ACTUAL tolerance (not their "I'm good to drive" assumption)
as well as
b) the actual REAL consequences of having "a couple drinks"?

Most young people who are trying to be responsible, (but might be hovering at the actual "impaired" level) could just need a real wake up call. I'm guessing sitting inside a RIDE van having to do a breathalyzer being scared out of their wits, blowing a .05 would be more effective deterrent than hearing lawmakers say NO DRINKS EVER YOU TERRIBLE CHILDREN.

That all being said, kids under 21 who are going to party, drink and drive are not going to change their habits because a BAC level law changes from .08/.05 to zero. We all know these types of people...if you're responsible with your drinking and transportation, then you're going to do something responsible. If you don't care, then 0-.05-.08 won't make a difference.

normal use of mouthwash does not trigger any response from a breathalyzer - believe me, I asked this same question when I was trained on it. We tried two different scenarios: normal usage of mouthwash, and actually drinking the mouthwash. Mouthwash does not register under normal use, and 7 ounces of mouthwash were required to register ANYTHING when it was swallowed. Only the most hardcore of mouthwash drinkers amongst our homeless would ever test positive.
