Also (now I don't know much about this stuff), wouldn't the club have been shut down for investigations if someone died?

There most definitely would have been an investagation. Something like this is not easy to hide.

How could that be a lawsuit waiting to happen? It seemed to be a pretty innocent post where he acknowledged that there may not even be any truth to what he was posting.

If I owned/managed the club, and found someone making that kind of unsubstantiated claim, regardless of whether or not they qualified it with a "maybe", I'd immediately contact that individual and threaten legal action unless they remove the remark.

I don't think it's unreasonable to expect legal recourse in a case where someone claims to have info that someone died in your establishment and implies that there's a cover up. Even saying "I heard that...but not sure if it's true" could possibly be construed as slander/libel/whatever, I would think?

If a club, or any other business, loses revenues due to an individual's words or actions they may seek legal action. So unless they can sufficiently prove that the cause of the damage was due to that individual stepping out of line, then they have no case. And I would think something like this would be extremely difficult to link back to one statement, considering the number of factors involved in running a club.

If my legal interpretation is wrong, someone in law or familiar with law (Jayx1 ), please correct me.

I see your point...but while it may be hard to prove tangible $$$ damages, particularly in a reputation case, that doesn't mean the club has no legal recourse...whether via civil court or by having him criminally charged.

(hey, it's a stretch to think someone would be sued/charged from a TA post...but...it could happen)

Think about it...if a newspaper published an article stating that a club covered up an overdose death...and it was not true...they would be sued and/or charged. Can the club *prove* tangible damages that were directly caused by the article? unlikely. It doesn't follow that the newspaper could print what it pleases though. Damage to reputation may not be easily quantified, but it's still a legit claim.

I'd say it's reasonably close to being the same thing for an individual posting online (though the net still remains a bit of a grey area in comparion to print media).
