Could have been worse. He could have jumped into the ocean and ended up in Tasmania with PKC.

They stole their national anthem from a children's nursery rhyme

source

quote:
Australian band Men at Work's worldwide hit "Down Under" breached the copyright of a children's nursery rhyme, according to the Australian Federal Court. The court found Thursday that the song's famous flute riff reproduced a "substantial part" of the tune "Kookaburra Sits in an Old Gum Tree." Larrikin Music, which owns the copyright to "Kookaburra," written in the 1930s by Marion Sinclair, will now seek to recover damages of up to 60% of royalties.

Written by Colin Hay and Ron Strykert in 1981, "Down Under" became an Aussie anthem and topped the local charts as well as charts in the U.K. and the U.S. The tune has been widely used in television shows and in films, including "Finding Nemo." Because of this, Larrikin's claim could run to millions of dollars. The legal action was launched in 2007 against Hay, Strykert and diskery EMI after the similarity was pointed out on music quizzer "Spicks and Specks," which airs on pubcaster the ABC.

yeah, i think men at work got jewed in that decision. the series of notes in question were a tiny fraction of the overall song.

I'm with you guys. I don't see much resemblance between the two.

Men At Work's Colin Hay shot himself in the foot, though, with this:

quote:
In his statement, Hay states that the flute riff was not added until 1979 when new band member "unconsciously referenced two bars of Kookaburra on the flute during live shows... and it did end up in the Men At Work recording"

the crazy thing is the original rights holder never sought any damages, and this company that did bring the action has only owned the rights since 1990 (which in itself is a bloody long time to wait to bring action).

Not to mention the company has sought 60% (!) of the money generated by the song

and I'm glad the small issue of an erosion of our freedom of speech last week was missed by pkc. South Australia, fuck yeah! At least it was rescinded after everyone cracked the shits

The government hid a law in amongst another law to get it through parliament. Basically it said that anyone who makes any comment about political issues during an election period had to attach their full real name and address.
It covered any written comments, newspaper comments, news websites, blogs, facebook, everything.

Michael Atkinson used the example of a blogger who kept making comments who supposedly lived in his electorate. He then went on to claim that the person was a Liberal staff member, it was a fake name and not anyone who lived in his electorate - even going so far to claim he knew everyone who lived in his electorate and he had also checked the electoral role (I would have thought a questionable action in itself).

The newspaper tracked this blogger down, sure enough a real guy, no links at all with the Liberal party, it was his real name, he lived about 2 streets away from Atkinson's electorate office, and this guy's wife had been into the office to have things signed.

Atkinson also claimed news websites and blogs were hotbeds of criminal defamation and lies, and thats why they needed the law.

We all knew Atkinson was a twat, but the law and him claiming this guy didn't exist was just the icing on the cake.

Ah that. Yeah, my gf was telling me a bit about it the other day. She didn't have all the background info though. Lol, that's hilarious. And disturbing.

I had a dream this night that I saw a picture on the internet that pictured that Death had died and he had to go to Australia when he died. An Australian greeted him at the gates with "It's time you know what a REAL HELL feels like".
