Dealer wants $1500?!

I bought an 03 350Z with 22,000km off a Nissan dealer several months ago. They inspected the car and said that was in "excellent, like new condition." I specifically asked about the transmission, as it's a major issue with these cars, and they said it was fine. As evident from my other thread, the clutch just died. They're saying it's because i wore it and that i owe them $1500. But the clutch is supposed to last 100,000km - this one is only at 29,000! Now, i'm assuming the previous owner wore the hell out of it. That, or there is a mechanical problem that caused it to get worn so quickly. Regardless, why should i pay for this?! If they inspected and failed to notice the problem, they should pay! If it was a mechanical problem, they should pay! There is NO WAY that the clutch was in "excellent condition" at 22,000 and DIED at 29,000 because of my driving! What the hell!!

If they inspected it when you bought it and it was fine, and 7,000kms later the disc was shredded, YOU FUCKING SUCK AT DRIVING STICK.

Now back to your regularly scheduled doldrums.

suck it up and pay for the new clutch because even if they missed it in their inspection you'll never prove it and, moreover, unless they guarenteed you the transmission was fine as a condition of sale you really have no recourse.

they inspected it and said it was fine. It failed. Unless you can prove that there was a problem, you're screwed. Shitty, but unless it's a manufacturer warrantied part, that's the way it is.

Tires and brakes "should" last a certain period of time, but how can you prove a defect vs. them calling it wear and tear or owner negligence?

For all they know, you can't drive...for all you know, they scammed you. The point is, it's your word against theirs and dealers rarely lose. Call Nissam customer service, complain as loudly as you can, point out how much you've promoted the car to others, etc...and hope they at least meet you halfway...

btw...this is the danger of buying used...you save a ton of cash, but even with impeccable service records, you have NO idea how the previous owner treated (or mistreated) the car. I'd be especially wary of buying a sports car used...for all you know, the prev. owner drove the shit out of it (or noticed a shitty tranny and sold it).

Clutches are wear items anyway. They'll never be covered under any sane manufacturer's warranty.

from their standpoint, you could have. The dealer isn't "nissan"...they are an independently owned dealership, right? i.e. if they do something under warranty, it's because "Nissan" pays for it. If it's a wear item, they won't be reimbursed by "Nissan", so they're not going to do the work and pay for the parts for free.

So your beef is with Nissan...not the dealer (unless you can prove it wasn't inspected).

like I said...call Nissan customer service and plead your case...that's about all you can do.
