I dunno, I dunno. There's pro's and con's to most laws. While I disagree with the law on the basis that 150 in 100 is a bit low, there are lots of situations where cops are allowed to "confiscate" property without a conviction.
As an example:
* I pick up a baseball bat at the store, walk up to a dude and smash his knees.
* Cops arrest me and certainly confiscate the bat (it's evidence).
* You of course notice that I'm not convicted of anything yet at that point in time - that little thing we call court hasn't happened yet 
This situation is no different. You can think of a vehicle that is moving too fast as a weapon. Indeed, if you're doing 90 in a school zone with a limit of 40, you are a stupid moron, your car is a potential deadly weapon, and should be confiscated.
