i dont see a problem:conf:
truck driver was negligent and it was dangerous, the car driver was drunk and dangerous too, but who injuried the other and was more dangerous: the truck driver!
example: I am drunk, walking on the sidewalk and zigzaging, the city workers forgot to put back the sewer cover once they were done. I fall in it, i didn't see it coming because I am drunk, and brake my bones, for sure I'm gonna sue! they were negligent!!! |

i totally agree.
He was only just over the limit, and should be punished for that, but they were totally negligent, and should be held responsible for that. |
