2 Tracks with the same sound but no remix??? Rip-off?Stolen?

Ok i was listening to this track a while ago:
Portishead - Roads
And a friend of mine suddenly said that he heard the intro part somewhere a break before, in another track..He thought and he thought...the track was:
Guy Gerber & Sahar Z - Kenny's Back (Mike Monday Mix)
He was speechless and so I was...but who ripped it off from who? Who knows about these tracks having the same breakdown?? Please get me info on this!
It's all about the intro part of Portishead - Roads, and the break of Guy Gerber & Sahar Z - Kenny's Back (Mike Monday Mix)..(I dont know about the Original mix of Kenny's Back so I use this mix to compare). Its the warm pad you hear. I hope I specific enough.

| Anyway, Roads is from 1994 and Kenny's Back was released last year. And I doubt anyone would be foolish to rip off Roads as it's a bit of a classic and would hardly go unnoticed. I haven't heard the Guy Gerber/Sahar Z track but presumably they either sampled it or, much more likely, the two just sound the same. This is not uncommon, especially considering it's just one part of each tune. I wish people wouldn't scream ripoff whenever similar-sounding tracks are dug out... |

| nah, he sampled it, kinda poorly in my opinion...the melody builds to a climax then he just kinda cuts it off. |

| Yes its sampled and personaly the kennys back is a brilliant track that has to be one of the best tracks of 2002... GU22 cd 1 dave seaman used this track :) |

| hehe I was a bit exaggerating a bit here, but what means "sampled" here? The original artist (Portisheads) created the sound. But did guy & sahar get permission to use the sound? Just curious |

You generally don't need permission to sample a track. A song in its entirety is of course subject to copyright, however, the same law does not apply, to my knowledge, to selected portions of tracks. So unless the resulting song sounds very similar overall to the sampled work there shouldn't be any legal issues. |
