even if he can't able to sue them, which i doubt, he can create a LOT of publicity for that club... people would be afraid to go somewhere where you get up for being drunk and starting a little ruckus...


but he still should file a report cuz even if he threw the first punch, the bouncers had no reason to do what they did.

Just recently, we had an incident where a well known sporting celebrity was killed *allegedly accidentally* by a bouncer after an altercation outside a club. Charges are yet to be laid :rolleyes:

Anyway, if I was him, I would sober up, and go back to that club with a sawn off shotgun, and start shooting every single one of the bastard s that ed with me that night.....:whip:

I wouldn't shoot each one of them... that'd be too easy on them. I'd put the gun up against their 'n balls and shoot them off. They'd have a hell of a time finding all the pieces. And considering they're all meathead-ogre-s, their 'n balls are the only thing they care about. I'm not even gonna post what I'd do to that sick of a manager.

still waiting to hear what country this was in, but here is how this might break down in the US...

1. if i was defending this case i would attempt to prove that the bar served him TOO much alcohol that night. they have a responsibility to keep the customers at a safe level. Just as if he was to go out and drive drunk and kill someone, they could be held liable for serving him too much. This would show that he was out of control at the fault of the bar. (i really don't feel like looking up the legal terms right now because i'm in a hurry, but if you want more info let me know).

2. it seems obvious to everyone here that they acted outside what would seem to be a normal amount of discipline. The fact that they beat him and then broadcast it into the club is definitely in your favor. it shows the brutality of the bouncers and the motives for the beating. once again i could go into more detail, but i got to go to class hehehe...

i hope that kinda gives you an idea about where to start a defense and definitely take the club to court. seriously, the fact that he was intoxicated will not justify the brutality that he was beaten and i'm sure that they will either shut down the club and/or impose heavy fines and damages to your friend.

there's probably alot of things to be taken into consideration...

- depending on the injuries your friend got from the fight, how long it will take him to recover, if he's required to go on disability insure for work, etc.

- if the bouncer filmed the fight as evidence, your friend would have access to the tape if they would decide to use it as evidence.

- im sure there would be more then enough evidence to pass a prelimanary hearing, and move onto a bigger tribunal.

- the role of a bouncer isn't to beat the of people, its obviously to maintain security of the club. im sure it would be possible that all of them be charged with assault, even possibly lose their occupations, the club owner who hires the bouncers can most likely be questioned since he had his part.

- if you were to have a case, you would easily be able to prove the credibility of the bouncers cause they all teamed up on your friend, and they each had their part in the fight.

smells like aggravated assault..... bouncers are always in a grey area situation ( i know i got loaded up one night in my hometown bar and picked a fight with one of them) but once they leave the club then its not so much of a grey area especially if there were witnesses that arent club employees... the key is to get the police report filled now and get the eyewitness statements now since the longer you wait the less credible it is. since it is canada the court case will take a while. but sometimes you will luck out and get an early settlement as lawyers do cost a load of money.another good route would be to talk to your insurance company. usually if the injurys are bad, they will give you dissability payments and then they go after the ******s who did it. my freind got hit by a bus last year, now she gets 3 or 4 grand every few months cause she cant work and the insurance company is suing the city bus company. that way if the case doesnt win its insurance that is ed for the money not your freind...


well best of luck... and next time your buddy goes clubbing tell him to keep a roll of quarters in his pocket...... works everytime :D

well, you could think of it in an example like a woman slaps a man in a fight, and then he proceeds to beat and rape her. sure, she had no right slapping him first, but what she did certainly didnt warrant a reaction like that. same with your buddy. he definitely can sue them, for assault and battery. AND if he points out that there is a videotape filming everything, then that is obviously hard evidence.

what kind of person gets a job so that they get the opertunity to hurt people. and there aint much you can do against them because your stories are instantly jaded due to being drunk!



if your mate had that severe injurys i take it u visited a doctor as in a "highly respected" member of the comunity and also now your best ally as he can say that the injurys recieved did not constitute "reasonable force" which is all bouncers are aloud to use.

"reasonable force" consists of restrainment not asult.

the major consideration is that these kinds of casses can cost you alot if you loose and you still aint garanteade of gettin more from them than you would be spending.

find other incodents from the same club of over excessive use of force and sell/tell the newspapers. things like that can be highly damaging to a clubs reputation and can also be used to help your case.

Your buddy's got a good case, but the longer he waits the worse it gets. It gets harder to find independant witnesses, and their credibility diminishes, his injuries heal, everyone's memories get cloudy etc.... so act quick.
