here's a dilemna maybe u can help me fight for...
my friend rachel was justfired from her job...they said, becausethey have reason to believe that she was involved in a "scam" between the the food court she works in and the coffee and smoothie bar below...
there was no proof given to her of how they know or if they even do...
and they also said they were firing her because she broke a "trust" with them
this trust being:
they had asked her not to tell anyone...but she did...myself and my friend kevin
but they hadsimply asked her this...
nothing was written down
can they do that? do they have the right to fire someone over just beliefs that she was doing something wrong?
oh by the way, she wasn't doing anything wrong
you see, this scam has to do with the free smoothie cards we give out at the coffee bar where i work...
you get a punch on these cards everytime u buy an expresso drink or smoothie...and when the card is full, you get a free one
well someone has been bribing the workers upstairs with these cards and/or giving them out to people already punched
rachel was not involved in this at all...
she had bought a lot of drinks from downstairs..and had a couple free smoothie cards from going b4
the nighttime manager is accusing her, my friend kevin, myself and i don't know who else in this so called scam
she's doing this solely because she doesn't like us
she accused rachel
and now rachel is fired
is there any way to protest this do you think? because they didn't give legitimate grounds for letting her go?? |

sue them for wrongly accusing 'rachel' and this conspiracy thing and get lots of free hot chololates or whatever. :D
but thats not a nice thing...being fired...i wouldnt know as i aint been fired yet...BTG has, ask him :D |

I wouldn't bother with it dude, I mean, she worked at a food court. That kind of ty job isn't worth the trouble. Just tell em to go themselves, sounds like she is better off not working for such dumb pricks.
The only negative impact it could have on her (unless of course she absolutly depends on this job for her income...which would suck) is that if she tries to apply for a job in the future, she can't use them as a reference, or if she does, they would probably talk about her negativly. I say just let it go. The time and money involved with something like sueing them really isn't worth it.
I laughed when I read what the "scam" was about. I've worked at both a smoothie bar and an espresso bar in the past where we have those stupid ing cards. I would punch them all the time and give them to my friends. Not that it really matters, you could very easily fake punch them to make them appear full. |

the reason it might be worth it is...
because they fired another employee a few days ago for the same reasons...
but again, not on legitimate grounds...
and guess who is in line next to get fired?

then my friend kevin...
and basically any of us that are just friends...since they "think" we're all involved
yeah it's a ing job...but i'm so angry that they think they can get away with this...
when they themselves are to blame for their poor management skills
but not only that, but she will not be able to get another job on the penn state campus...she'll be blacklisted... |

| A similar thing happened to the manager at one of my old jobs. Long story short, she got fired because of something she did which our DM told her was okay. The DM told her it was okay b/c he wanted her gone, and this was the only way he could have a "legitimate" reason for doing so (in actuality, he wanted her gone b/c he didn't like her). Well she went to the labour board about it and filed for wrongful dismissal. They agreed with her on the matter, after investigating of course, and she got UI for a year. It was only 60% of what she had earned at the job, but hey, at least she didn't let them her over. |

I know that in Canada and the UK, fired employees can file a lawsuit for wrongful dismissal.
I'm not sure exactly how the law works where you are; I think in the USA, a lot of labour law is governed by the state and not federally. Check your state law for wrongful dismissal/termination, things like that - if you can't find anything, then your friend just might be S.O.L. Believe it or not, the USA is one of the only countries that doesn't have comprehensive law in this area.
If it's really important then you'd probably want to consult a lawyer... if wrongful dismissal isn't an option, you could potentially track down the "whistle blower" and file a suit for slander or something like that... but I don't know the law well enough to make a good judgment there.
And if that doesn't work, the best thing you can do is go out with a big bang. :toothless |

Exactly - if they're going to fire you for scamming anyway, then you might as well start a real scam. :D |

| Is the cafe a chain? Is there someone higher up you can complain to about the incompetence of your managers? If so write them a polite letter detailing your concern for the future of the business under current management. |

finding which cars are theirs and slashing all their ing tires...
they have enough enemies that they couldn't prove who did it...
yet, it would still be great cuz everyone would know it would be us

all of our official managers (not the ones that actually work with us..and including the one that is ratting everyone out) were involved in the meetings...
but writing a letter or confronting them could be a good idea seeing as i'm not sure that all of the advisors were in agreement to do this firing by their noted reactions during the meeting
or we could just complain to the penn state food and housing services...
and who knows...maybe we can still start a real scam there...
even though we didn't before, it's obviously extremely easy to steal i still know the majority of people that work there... |
