i just got a big fat ticket for triple violations all at once.
the fine itself is $570 :o
this is my first time excluding the only time i got a speeding ticket in nor-cal, and didn't even bother to go to the court because i didn't want to drive 6 hours for that.
this time i got this ticket in my town, and i'm asking if i should go to the court, and if it'll be beneficial to me like reducing the fine if i could and stuff.
i just don't know how to handle this type of situation. any advice will be greatly appreciated. |

yes you should contest... i don't really know the details of you getting the tickets...
but try finding anything that could create some doubts in the mind of the judge. |

yea after talking to some people, and finding out that the court is only 3 min drive from my place :o, i decided to appeal.
if you're interested how i got my ticket, i made a left when there was a sign that says no left turn (though i really hadn't noticed because i was in hurry), and i didn't completely stop although i was nearly at a stop at the red light when i was making a right turn, and i had forgotten my wallet, hence no license on me at the time.
the cops are just ing lame. |

What, for doing their job? You were in the wrong place at the wrong time. Annoying yes, but that's no reason to hate someone who is just doing what they're paid to do. |

Exactly.
It wasn't the officers falt, he was just doing his job. I think its funny when people are like, "oh I hate the police," but when they need the police or something its the total opposite.
Of course all police officers aren't good, but most are. Many people stereo-type the majority of police officers as bad because of them. |

| listen police arent always doing their job..u guys have never been pulled over and searched on the street cause ur driving a nice car and u look like a young punk...u guys have never been harassed y police for no reason...u have never been at a friends house shooting the having polive taking pictures of you cause they thihnk ur tied into some drug scheme...wait till ur falsly accused of something and harassed abt it and then come back and tell me cops are oding their jobs..plzz |

could you elaborate a bit more pls? that sounds so good if it worked.
and back to the controversy, yea, i said what i said partly because they busted me. but mainly because of their attitute treating us like their ing toys.
i mean it's already bad enough to get pulled over and get tickets, but on top of that if they treat you like their slaves, how would you feel? yea that's right.
i was really coopertive and told them with respect, and elaborated my situations and everything like how i was in hurry to get to work and stuff. i dont mind getting the ticket, but even after i told them about my situation, they were ing just messing around calling their backups (i mean who needs a backup in situation like this anyway?) and yakking and giggling to each other. at some point, i thought they forgot about me pulled over in front of them.
it could've been done in 20-30 min, but it took over an hour for them to let me go, and i think that's really inconsiderate of them to do so. these are just a couple of examples of why cops are dicks.
they just make you feel that way that you want to slice them in parts and put them in their shoes, and throw them in the ocean. |

I'll clarify this for you.
Basically you are filing for "disclosure." In both Canada and the USA, you have a constitutional right to be informed of the nature of the charges you are facing, and that means you have a full right to know the facts of the case they have against you - specifically, the officer's copy of the ticket (front and back) and/or any written statements he made, as well as any witnesses that they might be using, any statements you made to him that he might use against you, and any other evidence that they intend to use at the trial. That's why, when you watch Law and Order, you'll see the defense attorney making an objection when the prosecuting attorney brings in a bloody knife that they just found yesterday after the trial began 3 days ago. The accused (you) has the right to know about ALL evidence in order to construct a full defense, and the prosecution cannot suddenly introduce new evidence at trial.
Now you CAN call the officer and ask for his copy of the ticket, but this could get you into trouble. For one thing, there is no record of the phone call, so they could just say you never asked. Here is what you want to do:
- Send your request for disclosure by registered mail to the prosecuting attorney. You can find out who this is by calling the court office, or you can just send it to the court office to the attention of the prosecuting attorney.
- Make sure you keep your receipt for the registered letter and find out exactly when it was received. Bring the evidence with you to court.
- If you don't receive disclosure, you make a motion for a dismissal on constitutional grounds due to a lack of disclosure. The court absolutely MUST dismiss the case if the prosecutor doesn't mail it to you or bring it to trial.
- If they decide to bring disclosure to the trial and give it to you there, then you make a motion for an adjournment so you can prepare a case on the evidence you've just obtained (this at least gives you another chance to have the trial on another day when the officer might not show up).
- DON'T wait until 2 weeks before the trial (I'm very surprised that hadi ****** has gotten away with it that!). That does not give them enough time to respond to your request. Make sure you send it at least 15 days before, that way they have (on average) 10 business days to respond, which is more than enough.
- If they do send you the disclosure by mail, you have to actually prepare a case. Disclosure is a constitutional right, it is not intended as an "easy out" for people charged with summary offenses. So don't think this is a "trick" you can use - it's just that the prosecutors often don't bother to send you the disclosure at all, or the cop doesn't show up to trial, and that's why people get off.

Well you do live in a different place, so it is possible that maybe you found a "bug" in the system. ;) I know that it does not work here in Ontario, but I'm not aware of the law all over - I was suggesting to him to err on the side of caution, but if what you're doing seems to work then I guess there's no reason to stop doing it. Just hope that one of these days, they don't send you disclosure 3 days before the trial, 'cause then you'll be screwed. :p
