well the case for the car, could be that you maybe IN your property(your car), but you are ON public property(the road).
this guy was IN his house and ON his property

What about people who rent or use subsidized housing? Thats technically someone else's property.
Anyways. This is exactly what i mean by give an inch and they take a mile. I hope this story illustrates my well founded fears of giving in to the "ban everything" hysteria. One day it just may come back to haunt you. |

The keyword in jayx1's post is hysteria...his own hysteria. It's one isolated case dude, and no one is screaming for a ban on masturbation at home, so your attempt at linking the two stories doesn't work.
This particular case should be thrown out of court, but i suspect since there are childern involved, the poor guy will have to win in court (which i hope he does / unless there was something else happening in his house which the article does not report ).
Ridiculous cases like this one always pop up in the justice system, and luckily they get dismissed just as quickly. To say that this is the beginning of the end is just an exercise in fearmongering. |

yes but by you paying the rent, and signing a lease, it allows you rent that space, not own it.
so if the OWNER stated that you could not smoke, they would be justified in doing so, because that is their property. |

Actually i believe the Tenant Protection act states that the owner cant prevent you from doing legal activity as long as you are responsible for the damages. That includes pets. |

yeah but what if it is written into the lease? then you are signing a contract saying you abide by the rules, or else |

regardless of what's written into a contract, the law is the law (for the most part) and a contract generally cannot supercede it.
If your employer writes into your employment agreement something that is illegal...then you're not bound by it, regardless of you signing it or not.
It's just like someone putting up a sign "beware of dog"...um, that's nice and courteous, but they are still legally responsible for their dog not biting someone conducting legal business at their residence (mailman, meter reader, etc). A sign rarely removes a legal duty of care. |
