How can companies spend some much money on lawyers? (pg. 2)

If you have health insurance they should cover it. The restaurant should be nice enough to do some workers comp. But in the end, you slipped and hurt yourself. Too many people blame "The Place Of Work" like its a ing entity. You arent suing A Company youre suing a person.

When my family was running our consulting firm we had an office down in Texas (us living in Seattle and running the offices there). A woman who was hired on as a salesperson worked there for a year. She didnt sell ANYTHING. No new accounts, no upping existing accounts, NOTHING. and her peers WERE. So the manager down there talked to her and she agreed that she wasnt cutting it and quit. She even signed a paper that said "I voluntarily leave this organization".

6 months later she couldnt find a job. So she tries to SUE for being unfairly terminated.

So its Sunday night, my family and I are sitting down for a nice dinner and we get a knock on the door. Its a gentleman SERVING us.

WTF. It was a lawsuit against the CEO of the company because "He should know whats going on in his own company". So they were suing my dad personally.

Soooo the company lawyer says "hey, just write me a check for 15 grand and itll be over"

"come again?"

"Oh, the other lawyer can drag this out forever with motions and it doesnt matter that she signed the paper. Itll cost 60 grand just to get to the point where they declare it unfit to go to court. Thisll 15grand will end it now"

so we wrote the check and it was over.

i edited my post...i left out an important part. before the fall, i would always bitch about it being too slippery and i would always say that someone could really hurt themselves, but no one gave a ..that's the restaurant business for you. and, the manager on staff that night (flaming gay cokehead ...i didn't like him that much, lol) knew i had a really bad fall, and he conveniently disappeared after because he didn't want me to fill out an accident report. the people who saw me fall were freaking out, they thought i should go to a doctor and get checked out cuz it was that bad of a fall. anyway, you can't file a suit if there was no accident report...i didn't know that at the time, but obviously the manager did. that really pisses me off when i think about it. but like i said, i don't think filing a suit is worth the time. i'm just thankful i live with a chiropractor:D i get free cracks and therapy.

oh and orbax, in a situation like that, of course it's asinine to sue...that lady was just trying to get money. screw her.

this is a prefectly good reason why i hate lawyers, the judicial system here, and especially these f'n small petty lawsuits ... they have the small claims courts for those, but do other countries have those? i think the u.s. is the only country that has small claims court.

the highly celebrated case you're talking about arose because the coffee was much hotter than it should have been, not because it was hot per se.

for instance, say you walk into a local coffee shop and you buy a coffee, you might expect it to be about 100 degree farenheit or so (whatever the case may be). suppose shop-owner sells you coffee that was 200 or more degrees F (or twice the temnperature), then under the law that may be unlawful as negligence because a reasonable person would not sell coffee that hot.

yes, the law sucks sometimes, but were there are benefits, there are costs. that's the system though.

its a ridiculous concept.

you make coffee with boiling water, which is around 100 degree centigrade, and will not deviate more than 1 or 2 degrees above that. when you buy coffee what the hell do you expect? if you gulp a cup of coffee down without taking a little sip to test the heat first its your own stupid fault. unless you are in america that is...

can people sue kettle manufacturers because they boil the water too hot? what happens if your mum makes you a cup of coffee?

it seems that even if it is down to pure stupidity, you need to be bloody warned about it. do they put warnings on knives?
