My legal understanding may be flawed, but I'm guessing that the "escape clause" has something to do with private clubs being able to reasonably discriminate. eg. Boy Scouts is for boys ages ___ to ___...so if you're 5 or 45, you can't join in the same capacity.

It is flawed, Mark. The main reason is that the escape clause was denied for other organizations in similar situations: Golf clubs (esp. men's golf clubs - there was a whole -storm about this just 1 month ago), the Big Brothers association, and let's not forget men's health clubs!

Well, actually I suppose it's not your legal understanding that's flawed - you obviously understand the escape clause. The problem is, MANY organizations that SHOULD have been allowed to use the escape clause, weren't. Canadian courts (and I'm going to say liberal judges, sorry but it's true) have become ridiculously overzealous about "discrimination" issues and overruled the clause in many inappropriate situations.

I don't think that this guy is HONESTLY trying to get the courts to force the women's club to let him join. I think he is trying to expose the utter hypocrisy of these liberal judges, because he knows that he is going to lose the case and that will set a precedent for other organizations who should have the right to reasonably discriminate.

Discrimination is not morally wrong by definition. It's only wrong when the characteristic being discriminated against is totally irrelevant.

Exactly: This is why i love this suit. Everyone freaks out over "mens only golf clubs" and they wont allow men to be girl guide leaders (however women can be scout leaders) yet this guy cant be enrolled in a women's gym? You can damn well bet if it were the other way around this thread would be taking on a whole different tone.

Should women be allowed to have their own club? Absolutely! But the fact is that this same right should be extended to men. It hasn't been and thats why i think this suit is great. Hopefully it will teach a few lessons about TRUE equality.

thats hoping for too much.

reverse discrimination (ie women = greater than men) will reach new extremes in the not so distant future.:nervous:
