I don't have money for a lawyer, anyone know any law forums or anything where I could ask these questions? I feel confident going their and defending myself once I've educated myself on the laws, but the law on possession that I found online was vague at best. |

www.westlaw.com is best place for it. unfortunately it's really used only in law firms because the charges get allocated to clients...
westlaw can find all relevant case law for any topic you choose (i should know, i had training today on how to run searches heh)
also, i'm sure a lot of places give free consultations? that's what i think with criminal cases... if not there's always public defender... |

Well that's what I figured if you go down there on the date you can get a public defender appointed to you no? So I figured I would just try and find out all the information I can first, than go down there get a public defender and go over it with them. |

They're probably going to give you some bull excuse like "If you are in full knowledge that the person(s) you are with is/are in possession, you face being charged with possession as well, lest you walk away." The law's a bitch. :( |

| Okay, enough you need a lawyer, the courts will you over if you don't, you can not educate yourself enough on it. A lawyer my cost some money but your messing with having this on your record forever. I say this cause I have a friend that got busted for having a bowl in his car and the cops used that for the possession charge, he got a lawyer and got 6 months of drug testing by the court and if he failed possible jail time. He was in a car with a friend, the friend go the same charge although there was only one bowl and his friend told his dad, dad paid for an awesome lawyer and the kid got off with nothing. My friend was even told by the cops he was lucky he got a lawyer cause if not he was guar. 48 hours in jail, on his record, a fine and drug testing. SO if your down with that then go for it, but I think take the advice of all here and got a lawyer!!!!!!!!!!! |

If you didn't do an overnight you should be ok with a misdemeanor or even a violation (which is nothing more than a fine) I would say to get a lawyer and explain the case to him, he'll take your case for little money since it will count as a win for him. He will either get you off with nothing or a violation. if you don't get a lawyer, one will not be appointed to you, inorder to get one appointed you need to prove you can not afford one. You will get immediately audited (or atleast thats what they told me when I got bagged)
as for it going on your record, i don't think you have much to worry about unless you are convicted of a felony. I believe most run-ins with the law happen during the time of college. If you have a string of run-ins with the law then it might prove you have a trackrecord with them which might reflect something bad. If you have unrelated sparse incidents through out college, it's understandable. It's college people do dumb things - it'll blow over don't worry |

Plead not guilty and appear for court, as long as your record is clean chances are the judge will dismiss it. Oh yea and in court look very scared and remorseful, it worked for me.
Everyone in the car is accountable for the possesion if I am not mistaken, the only way you could try to get out of that one is saying that you had no knowledge of it, for instance if they were in the back seat and you were in the front and not paying attention and didnt see anything yourself and even then they probably wont buy it.
And public defenders are not on your side :whip: :whip: |

Tek is right. Although im not to familiar with NY state laws....but a summons charge in PA is pretty much like getting a speeding ticket....it's not even a misdemeanor. Slap on the hand kid.;) |
